These Terms of Service ("Terms") govern your use of the Gadget Groove POS platform ("Service"), operated by Gadget Groove POS ("we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account or using the Service, you confirm that you are at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or your business. If you do not agree to these Terms, you may not use the Service.
2. Description of Service
Gadget Groove POS is a cloud-based point-of-sale, repair management, and business operations platform designed for electronics repair businesses. The Service includes:
- Point-of-sale and payment processing
- Repair ticket management and tracking
- Inventory and product catalog management
- Customer relationship management
- Employee management, scheduling, and time tracking
- Reporting and analytics
- Third-party integrations (Google Business Profile, messaging, etc.)
3. Accounts and Registration
- You must provide accurate and complete information when creating an account
- You are responsible for maintaining the confidentiality of your login credentials
- You are responsible for all activities that occur under your account
- You must notify us immediately of any unauthorized use of your account
4. Subscription and Payments
4.1 Plans and Pricing
The Service is offered through subscription plans (Basic and Pro) on a per-location, per-month basis. Pricing details are available within the platform and on our website.
4.2 Billing
- Subscriptions are billed monthly through Stripe
- You authorize us to charge your payment method on file for recurring subscription fees
- All fees are non-refundable except as required by law
4.3 Free Trial
New accounts may include a free trial period. At the end of the trial, you must subscribe to a paid plan to continue using the Service. If you do not subscribe, your account will be placed in read-only mode.
4.4 Cancellation
You may cancel your subscription at any time from within the platform. Upon cancellation, your access will continue until the end of the current billing period.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to the Service or its systems
- Interfere with or disrupt the integrity or performance of the Service
- Reverse engineer, decompile, or disassemble any part of the Service
- Use the Service to store or transmit malicious code
- Resell, sublicense, or redistribute the Service without our written consent
6. Data Ownership
- Your Data: You retain all ownership rights to the business data you enter into the Service (customer records, transactions, inventory, etc.)
- Our Platform: We retain all rights to the Service, its software, design, and underlying technology
- We will not access, use, or share your business data except as necessary to provide the Service, as described in our Privacy Policy
7. Third-Party Integrations
The Service allows you to connect third-party services such as Google Business Profile, Twilio, and Stripe. By enabling these integrations:
- You authorize us to access and use data from these services as needed to provide the integration features
- You acknowledge that third-party services are governed by their own terms and privacy policies
- You may disconnect any integration at any time from within the platform
8. Service Availability
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may perform scheduled maintenance, updates, and improvements that may temporarily affect availability. We are not liable for any downtime or service interruptions.
9. Limitation of Liability
To the maximum extent permitted by law:
- The Service is provided "as is" without warranties of any kind, express or implied
- We are not liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim
10. Indemnification
You agree to indemnify and hold us harmless from any claims, losses, or damages (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
11. Termination
We may suspend or terminate your access to the Service at any time if:
- You violate these Terms
- Your subscription payment fails and is not resolved
- We are required to do so by law
Upon termination, your right to use the Service ceases immediately. We will retain your data for 90 days to allow for export, after which it may be permanently deleted.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws of the State of South Carolina, United States, without regard to conflict of law principles.
